1. Introduction
These Terms and Conditions govern your use of the Markety website and any services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our site or services.
Markety operates as a digital marketing and lead generation agency. Questions about these Terms can be directed to info@marketyleadgen.com.
2. Services
Markety provides lead generation, paid advertising management, email marketing, landing page creation, funnel architecture, and related digital marketing services. The exact scope of services for each client is agreed in writing before work begins.
We reserve the right to refuse service to any party at our sole discretion.
3. Client responsibilities
When working with Markety, you agree to:
- Provide accurate and complete information about your business and goals.
- Grant us the necessary access to your ad accounts, platforms, and tools required to deliver the agreed services.
- Respond to our communications within a reasonable timeframe.
- Ensure that any content, materials, or information you provide to us does not infringe any third-party rights or violate applicable law.
4. Payment terms
Our pricing is based on the leads we deliver, as agreed in writing before engagement. Invoices are due within 14 days of issue unless otherwise agreed. Late payments may result in a pause of services until the outstanding balance is settled.
All prices are exclusive of any applicable taxes unless stated otherwise. You are responsible for any taxes applicable in your jurisdiction.
4a. Setup fee and minimum engagement
Before any campaign goes live, Markety invests significant time building your system - including landing pages, ad campaigns, email sequences, tracking, and account configuration. This work is carried out in good faith based on your commitment to the engagement.
As a result, the following terms apply:
- If a client stops using Markety after the setup phase is complete and has received fewer than 20 qualified leads, the client agrees to pay a one-time setup fee of USD $50. No setup fee applies if the client remains engaged until receiving at least 20 qualified leads or otherwise continues using Markety after setup is complete.
- After your campaigns go live, you agree to maintain the engagement for a minimum of 30 days. This allows sufficient time for campaigns to generate data, optimise, and deliver meaningful results.
- If you terminate the engagement within 30 days of your campaign launch date, a cancellation fee equal to 50% of one month's estimated lead spend is due. This compensates Markety for the setup work invested and the opportunity cost of declining other clients during your onboarding.
- Cancellations must be submitted in writing to info@marketyleadgen.com. The 30-day period begins from the date your campaigns go live, not from the date of first contact.
5. Intellectual property
All campaign assets, landing pages, email sequences, and creative materials built by Markety for your account are owned by you upon full payment. Markety retains no claim over work delivered and paid for.
Any tools, templates, methodologies, or processes developed by Markety remain the intellectual property of Markety and are licensed to you for use during the engagement only.
6. Confidentiality
Both parties agree to keep confidential any non-public information shared during the engagement, including but not limited to business strategy, pricing, client data, and performance metrics. This obligation survives the termination of any agreement.
7. Results and guarantees
Markety works to deliver qualified leads as defined and agreed before an engagement begins. However, we cannot guarantee specific outcomes, revenue, or conversion rates, as results depend on factors outside our control including market conditions, your sales process, and platform performance.
We are committed to transparency. If campaigns are underperforming, we will tell you promptly and adjust our approach.
8. Termination
Either party may terminate the engagement with 14 days written notice, subject to the minimum engagement period described in section 4a. We operate on a month-to-month basis after the initial 30-day period.
Upon termination, all assets built in your accounts remain yours once all outstanding invoices are settled. Any invoices for work completed up to the termination date - including the setup fee and any applicable cancellation fee under section 4a - remain payable in full.
Markety reserves the right to terminate the engagement immediately if a client repeatedly fails to pay invoices on time, provides false information, or acts in a way that makes continued work impossible or unreasonable.
9. Limitation of liability
To the maximum extent permitted by law, Markety's total liability to you for any claim arising out of or in connection with our services shall not exceed the total fees paid by you in the three months preceding the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue or loss of data.
10. Use of this website
You may use this website for lawful purposes only. You must not use it in any way that violates applicable local, national, or international law or regulation, or to transmit any unsolicited commercial communications.
We reserve the right to suspend or terminate access to this website for anyone who violates these Terms.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
